Terms of Service

Agreement to Terms

By accessing or using Lumen Guard ("the App"), developed by Beans & Brackets ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our application.

These Terms constitute a legally binding agreement between you and Beans & Brackets. We reserve the right to modify these Terms at any time, and your continued use of the App after changes are posted constitutes acceptance of those changes.

Description of Service

Lumen Guard is a screen dimming and colour-warmth application for Android. The App provides:

• Adjustable screen dimming beyond system limits
• Customizable warmth levels
• Custom scenes for different use cases
• Scheduling functionality for automatic filter changes
• An optional floating widget for quick access

Use of Our Service

License Grant: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Lumen Guard for personal, non-commercial purposes.

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the integrity or performance of the App
• Attempt to gain unauthorized access to any services or systems
• Use the App to transmit viruses, malware, or other harmful code
• Resell, redistribute, or sublicense the App without permission

Permissions and System Access

Lumen Guard requires certain system permissions to function properly:

• Draw Over Other Apps: Required to display the dimming overlay
• Foreground Service: Required to keep an active overlay available while you use other apps
• Notifications: Optional for filter status and optional reminders; core filtering still works if notifications are off
• Internet and Google Play Billing: Used for Google Mobile Ads in the free version and for an optional premium purchase
• Boot recovery: Used to restore enabled schedules after device restart

By granting these permissions, you acknowledge that these are necessary for the App's core functionality and agree to the associated data handling as described in our Privacy Policy.

Free and Premium Versions

Free Version

The free version of Lumen Guard includes advertisements and has certain feature limitations:

• Core dimming and warmth controls
• A free preset scene
• Banner advertisements and optional rewarded advertisements

Premium Version

Lumen Guard Premium is available as a one-time purchase and includes:

• Ad-free experience
• Unlimited custom scenes
• Unlimited schedules
• Floating widget access

Premium Features and Payments

Premium features are available through Google Play's in-app purchase system. By purchasing premium features, you agree to the following:

• All purchases are processed through Google Play's payment system
• Premium is a one-time purchase providing lifetime access
• Refunds are subject to Google Play's refund policies
• Premium features are licensed, not sold, and may be revoked for Terms violations

Intellectual Property Rights

All content, features, and functionality of Lumen Guard, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Beans & Brackets and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not use our trademarks, service marks, or logos without our prior written consent.

Disclaimer of Warranties

This includes but is not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or completeness of content
• Warranties that defects will be corrected

Display Disclaimer: Lumen Guard changes the appearance of the display. It is not a medical device and is not a substitute for professional eye care. Consult an eye care professional for vision-related concerns.

Limitation of Liability

To the maximum extent permitted by law, Beans & Brackets shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your transmissions or data
• Damages resulting from any conduct or content of third parties
• Damages related to your use or inability to use the App

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is less.

Indemnification

You agree to indemnify, defend, and hold harmless Beans & Brackets, its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of Lumen Guard
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

Privacy and Data Protection

Your use of Lumen Guard is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle information and data.

Advertising and Third-Party Services

The free version currently uses Google Mobile Ads for banner ads and optional rewarded ads. Google services are governed by their own terms and privacy policies. Please review our Privacy Policy and Google's applicable policies for more information.

Optional Rewarded Ads

A rewarded ad is never required to use Lumen Guard's core filter controls. Before each rewarded ad, the App describes the specific temporary in-app reward. You choose whether to watch the ad; declining or closing it does not prevent normal use of the App. A promised reward is granted only after the reward criteria for that ad are completed.

Termination

We may terminate or suspend your access to Lumen Guard immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws or regulations
• Fraudulent, harassing, or abusive behavior
• At our sole discretion for any other reason

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or Lumen Guard shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration or in the courts of competent jurisdiction.

Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use Lumen Guard after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the App.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Beans & Brackets regarding your use of Lumen Guard, and supersede all prior agreements and understandings.
